This Holiday season ASK and TRACK are excited to continue our support of the group of unwed Korean mothers raising their children. Miss Mamma Mia is a newly founded organization that is a support network for single moms but more importantly, it’s a group of dedicated mothers working to improve and change the laws that affect single mothers in Korea.

This group was started by single mothers for single mothers, and they have been supporting both ASK and TRACK in our various events and campaigns.  Therefore, this holiday season, we would like to return their support them through gift giving!  ^.^  We have asked them to compose a brief bio, and a list of things they need that would make their lives easier and more FUN!

Please check the list and donate an item or two if you can!  Or gather a group of friends and donate all the items to a whole family!  Or gather a group to donate a more expensive item! Below you will be able to find the bios, the items, and the estimated cost of the items on the wish list.  If you are interested in participating, in order to prevent duplicate purchases, you can check the updated list of which items have already been purchased and which items still remain here on the TRACK Web site. Our family is myself and my son Chung Won who is American age three years old.  I have studied Russian and English.  And my son is starting to get interested in learning English these days.  He always asks me “what is this (pointing to something) in English?”  Sometimes I don’t even know it in Korean! ^^ He loves to read books and play with his friends.

[해외입양인, 말걸기] 한국 미혼모를 후원하는 프랑스인 그렉, 기사입력 2009-11-25 오전 8:00:16

44세의 프랑스인 그렉(Greg Peña-Rodriguez)과 한국의 연결고리를 찾기는 쉽지 않다. 그가 한국과 인연을 맺게된 것은 ‘해외입양’이라는 키워드를 통해서다.

“한국은 가장 긴 국제 입양 역사와 최대 규모의 경험을 가진 국가로서 전 세계의 국제 입양에 대한 표준이 되어왔습니다. 한국은 국제입양의 측면에서 가장 바람직한 결과를 볼 수 있는 나라이며, 또한 타 국가들이 기피해야 하는 미래를 보여주는 나라이기도 합니다.”

그는 한국의 해외입양인 단체인 TRACK의 중요한 후원자 중 한 사람이다. 한국은 더 이상 아이들을 해외입양을 보내야 할 정도로 가난한 나라가 아니지만 과거의 입양 경험을 통해 공고하게 만들어진 시스템을 통해 여전히 해외입양을 보내고 있다. 때문에 해외입양을 통해 발생한 ‘비극’의 연결고리를 끊는 방법 역시 한국에서 찾아져야 한다고 그렉은 생각한다.

그렉이 찾은 대안 중 하나가 미혼모들을 지원하는 것이다. “남성이 저지른 일은 생각지도 않고 미혼모들에게 돌팔매질을 하는 것은 그들을 사회의 희생양으로 만드는 것”이라고 그는 말한다. “한국이야 말로 단순한 인권 보호 차원을 뛰어 넘어, 입양과 관련하여 전 세계적으로 자행되고 있는 인간의 기본권리인 자신의 자식을 키울 권리에 대한 만행과 싸워 첫 승리를 얻을 수 있는 나라라고 생각한다”고 말한다. 편집자

지난 22일 <중앙일보>는 보건복지가족부가 기획재정부에 미혼모지원을 위해 275억 원의 예산을 건의하였다는 내용의 기사를 보도하였습니다. 이는 전년도의 16억 원의 예산에서 크게 증가된 것입니다. 모든 미혼모들이 동일한 어려움을 겪고 있다는 사실을 보았을 때, 지원대상이 18세에서 24세 사이의 미혼모들에 한정되었다는 사실이 실망스러운 것은 사실이나, 정부의 정책이 올바를 방향으로 한걸음 나아갔다는 것은 반가운 사실입니다. 한국인 해외입양아의 모임인 TRACK과 그의 후원자들은 23일과 24일 양일 사이에 있을 심의에서 보건복지가족부의 제안이 긍정적으로 검토될 수 있도록 관계자들을 독려하고 있습니다.

해외로 입양되는 아동의 90% 이상이 미혼모의 아이이기 때문에, 국제 입양사회는 현재 한국의 미혼모들이 처해있는 상황에 깊은 관심을 보이고 있습니다. 한국사회는 20만 명에 가까운 아동을 해외로 입양을 보낸 역사를 가지고 있으며 이에 따라 한국에는 미혼모 지원정책에 큰 관심을 가지고 있는 사람들의 모임이 생겨났습니다. 이 모임은 입양아뿐만 아니라 그들의 가족 및 친구들로 이루어져 있습니다.

‘두개의 코리아’는 현실…입양정책 방향 전환해야

한반도 통일은, 국외 입양인들에게 자신의 ‘뿌리’에 닿아 있다. 한국의 국외 입양 역사가 한반도 분단에 직결돼 있다고 여기기 때문이다. “한국은 지리적으로 분단된 나라일 뿐만 아니라, 국외 입양으로 많은 이들을 신체적으로, 정신적·심리적으로 분리시킨 나라이다.” 스웨덴 입양 한인 에릭 칠웅 브루네고드(39·한국 이름 김칠웅)씨의 말이다. 고등학생 때 태권도를 처음 배우며 남·북한 각각 꾸린 태권도연맹을 접하고는 ‘두 개의 코리아’를 실감했다는 다니엘 리(33)씨의 체험은, 국외 입양인들에게 분단은 일상에서 직면하는 현실임을 보여준다. 그러나, 한국인 입양인들이 이처럼 “한국의 현대사와 긴밀하게 얽혀 있고, 하나의 국제 커뮤니티에 속해 있기에” 한반도 통일 과정에서 남·북한을 연결하는 중요한 구실을 할 수 있을 것이라고 브루네고드씨는 강조했다.

Five naked people Removal of Korea’s stigma as a big child-exporting country

Politicians, government, civil society make an effort to overall revise the child adoption system.

Politicians, government and civil society endeavor altogether to revise the adoption law to remove the stigma that Korea is a big country for adoption.

Choi-Young-Hee, a lawmaker in the Democratic Party, is working on the overall revision process of the special law on child adoption promotion and procedures.

She announced that she will send an amendment to the regular session of the National Assembly and urge the ratification of the Hague Convention on Intercountry Adoption, which includes 78 countries- the U.S., France, Australia, etc, related to international adoption and child protection.

On Oct. 10, during the public hearing for the Special Adoption Law co-sponsored by the Future Forum of Children and Juveniles, Rep. Choi said the government has spent over 500 million won on just advertising and suffers from a low birth rate, but still deals passively with the reality that 1250 children were adopted overseas last year, claiming the necessity of revising the child adoption system.

According to the attorney So Rami from the public interest attorney group Gonggam, which is doing the revision of the adoption law with Rep. Choi, the revised law is different from the previous one for the following reasons:

1. The adoption law does not pursue the unconditional promotion of adoption anymore, and gives higher priority to custody in the country where the children are born and their birth family, rather than overseas adoption.
2. Increasing the range of law application from “children who need protection” to “children who cannot be protected by their birth family.”

Especially, it gives clear suggestions on introducing new systems such as a “consideration of adoption” that secures the birth mother’s right to raise her child, and a “court permission system” to ban the abuse of the adoption system.

In addition, in the course of revising the law, they are considering what is in the “best interests of the child” and securing the adoptees’ access to information as their right.

This preparation of the law revision reflects the opinions of the adoptee community, such as TRACK and ASK.

Before that, on Oct. 6, the Anti-Corruption & Civil Rights Commission (Chairman Lee Jae Oh) prepared overall “ways of increasing adoptee’s rights and benefits” and suggested systematic improvement to related authorities, such as the Ministry of Health and Welfare, the Ministry of Justice, the Ministry of Labor, the Ministry of Public Administration and Security, and the Ministry of Foreign Affairs and Trade.

Especially, the Anti-Corruption & Civil Rights Commission suggested installing a central authority to manage adoptions and giving an allowance to unwed mothers in case they decided to raise to their child instead of sending the child for adoption.

Meanwhile, the competent authority, the Ministry of Health and Welfare, is also examining the laws related to adoption, and they announced that they will hand out the fully revised law to the National Assembly within the first half of next year.

‘아동 수출 대국’ 오명 벗는다

정치권·정부·시민사회, 입양제도 전면 개편 작업 중

‘한국은 아동 수출 대국’이라는 오명을 씻기 위한 입양제도 전면 개편에 정치권과 정부, 시민사회가 일제히 발 벗고 나섰다.

민주당 최영희 의원은 현재 ‘입양 촉진 및 절차에 관한 특례법’ 전면개정 작업을 진행 중으로, 이번 정기국회에 개정안을 제출하고 미국, 프랑스, 호주 등 총 78개국이 가입되어 있는 ‘국제입양 관련 아동보호 및 협력에 관한 협약(헤이그 협약)’의 비준을 촉구할 예정이라고 밝혔다. 최 의원은 10일 국회 아동청소년 미래포럼 공동대표 자격으로 개최한 입양특례법 개정 공청회에서 “정부가 저출산으로 몸살을 앓으며 관련 홍보비만도 50억원을 쓰고 있으면서, 지난 한 해 1250명의 아동이 해외로 입양되고 있는 현실에는 여전히 소극적으로 대처하고 있다”며 입양제도 개선의 필요성을 강력히 주장했다.

최 의원과 함께 입양특례법 개정 작업을 하고 있는 공익 변호사 그룹 공감의 소라미 변호사에 따르면, 개정안은 과거의 무조건적인 입양 ‘촉진’을 지양하고 친가족과 출신 국가의 양육 보호를 국외입양보다 우선시하며, 법 적용 대상을 ‘요보호 아동’에서 ‘원가정 보호가 어려운 아동’으로 확대하고 있다는 점에서 현행법과 출발점을 달리한다. 특히 친모의 직접 양육 선택권을 보장하기 위한 ‘입양숙려제도’, 입양제도 악용을 막기 위한 ‘법원허가제도’ 등 새로운 제도 도입도 명시하고 있다. 또한 입양인의 정보 접근권을 ‘권리’로서 보호하는 등 “아동의 이익을 최우선으로” 하는 방향으로 입양 절차를 정비하고 있다. 이번 개정안 준비에는 진실과 화해를 위한 해외입양인모임(TRACK), 국외입양인연대(ASK) 등 입양인 단체들의 의견도 반영된 것으로 알려졌다.

앞서 지난 6일 국민권익위원회(위원장 이재오)는 종합적인 ‘입양인 권익 증진 방안’을 마련해 관련 부처인 보건복지가족부, 법무부, 노동부, 행정안전부, 외교통상부에 제도 개선을 권고했다. 권익위 방안에서는 특히 현재 국가 차원의 지원에서 배제되고 있는 미혼모가 아이를 입양시키지 않고 직접 키울 경우 양육수당을 지급할 것과 입양업무를 총괄 관리할 국가차원의 종합기구를 설치할 것을 제안하고 있다.

한편 주무부처인 보건복지가족부 역시 현재 입양 관련 법령을 종합적으로 검토하고 있으며, 내년 상반기 중으로 전면 개정안을 제출할 계획이라고 밝혔다.

최근 일부 산부인과 의사가 “더 이상 불법적인 인공임신중절(낙태) 시술을 하지 않겠다”고 선언하면서 낙태 찬반 논쟁이 새삼 달아오르고 있다. 4년 전 추정 조사된 정부의 공식 통계로만 연간 35만여 명의 태아가 엄마 배 속에서 사라지고 있다. 높은 낙태율을 우리 사회의 뿌리 깊은 남아선호 사상 탓으로 돌리는 목소리는 과거에 비해 크게 줄었다. 그보다는, 성문화가 급변하면서 늘어난 혼전임신이 낙태의 주요 원인이 되고 있다. 아이를 낳고 싶어도 미혼모가 감내해야 할 사회적·경제적 어려움이 엄청나기 때문이다. ‘가슴으로 낳는 아이’라는 입양도, 미혼모들의 눈물이 있기에 가능하다는 것이다. 10~30대의 미혼모 7명을 만났다. 낙태 대신 생명을, 입양 대신 양육을 선택한 이들에게 과연 후회는 없을까. 그들은 모든 사연을 솔직히 들려주었지만 대부분 얼굴과 이름은 공개하지 못했다. 그들이 처해 있는 냉혹한 현실을 말해주는 듯했다.

‘한국미혼모지원네트워크(www.kumsn.org)’는 국내에 보기 드문 미혼모 권익옹호 단체다. 2007년 설립 이래 각종 관련 사업과 연구를 후원해 왔다. 올 들어 한국여성정책연구원이 발표한 미혼모 관련 국민의식조사·복지실태연구도 이런 결과물이다. 이 단체를 설립한 이는 미국 코네티컷에 사는 안과의사 리처드 보아스(59·사진) 박사다. 세 딸 중 막내 에스터를 1980년대 말 한국에서 입양한 아버지다. 중앙SUNDAY의 e-메일 인터뷰 요청에 그는 장문의 답변을 보내 왔다. 재단을 설립해 미국인 가정에 입양비용을 지원할 만큼 국제입양을 지지했던 자신의 생각이 어떻게 바뀌었는지를 상세하게 담았다.

275억 복지부 예산, 국회 얼마나 받아줄까

보건복지가족부는 올 초 기획재정부에 제출한 내년도 예산안에 미혼모 대책과 관련, 275억원의 지원금을 포함시켰다. 미혼모 중에서도 우선 청소년법의 지원근거인 24세 이하의 양육 미혼모에 대해서라도 일반 한부모가구보다 지원을 좀 더 늘리자는 것이다. 주요 내용은 ▶기초수급권자가 아닌 경우 한부모가구지원법에 따라 지원되는 월 5만원의 양육비를 15만원으로 늘리고(52억5000만원) ▶의료급여를 받지 못하는 미혼모에겐 연 29만원 이내의 자녀 의료비를 지급하며(8억3000만원) ▶학업을 중단한 미혼모에겐 검정고시 학습바우처를 제공하는(52억7000만원) 것이다. 또 ▶자립 자금을 마련할 수 있도록 소득액에 따라 월 5만~20만원 한도 내에서 미혼모가 저축하는 만큼 정부에서 같은 금액을 계좌에 넣어주며(38억1000만원) ▶기초수급 대상에서 탈피하거나 자립했을 경우 성공수당 등을 지급하고(72억4000만원) ▶미혼모자 양육시설 등을 확충하는(51억원) 것 등이다.

복지부의 이런 대책은 그러나 정부 내에서조차 지지를 받지 못하고 있다. 정확한 미혼모 실태 파악조차 안 된 상태에서 300억원 가까운 예산을 배정할 수는 없다는 이유에서다. 실제로 미혼모에 대해서는 공식적인 실태 조사 자료가 전무하다. 낙태(인공임신중절) 실태만 해도 2005년 복지부가 고려대 산부인과 김해중 교수팀에 의뢰해 전국적으로 표본조사한 추정자료가 있을 뿐이다. 미혼모와 관련해서는 따로 조사한 적이 없다. 미혼모들이 대답을 꺼려한다지만 인구주택총조사를 할 때도 응답자가 미혼으로 답하면 자녀 출산에 대해서는 아예 묻지도 않도록 문항이 설계돼 있을 만큼 실태 파악에 소극적이다. 스웨덴이나 프랑스도 미혼모 통계가 없지만 이는 모든 양육 가정에 다양한 수당을 주기 때문에 혼인 여부를 따질 필요가 없기 때문이다.

그나마 국내 미혼모에 대한 실태를 가늠할 수 있는 최근 자료는 한국여성정책연구원이 한국미혼모지원네트워크의 의뢰를 받아 조사해 지난 5월 발표한 자료다. 이 자료에 따르면 아이를 직접 양육하는 미혼모는 1991년 472명에서 2001년 586명, 그리고 2007년엔 2464명으로 크게 늘고 있다. 혼외관계로 출생한 자녀 수와 국내외 입양아동 중 미혼모 아동 수, 그리고 시설에 거주하는 미혼모들을 대상으로 조사됐던 양육 희망률 등을 토대로 추정한 최소치다. 양육을 희망하는 미혼모는 98년 1.2%에서 2005년 31.7%로 급증하고 있다.

미혼모시설인 ‘애란원’의 한상순 원장은 “정부나 지자체가 저출산 대책에 부산을 떨면서도 정작 낙태 대신 출산을 선택한 미혼모에 대해서는 바람직하지 못한 임신을 부추긴다는 ‘역풍’을 두려워해 지원을 꺼리는 것 같다”고 말했다. 낙태 문제와 관련, “양육 미혼모에 대한 지원이 강화되면 해결의 실마리를 찾을 수 있을 것”이라고 덧붙였다. 여성정책연구원 조사에 따르면 혼외 임신의 95.7%는 낙태되고 있는 것으로 추정된다. 한 원장은 또 “미혼모를 시설을 통해 지원하는 것도 한계가 있는 만큼 그들에게 주거환경을 마련해 주면서 지역사회에서 다양한 지원을 받을 수 있도록 해야 한다”고 말했다.

23, 24일엔 국회 보건복지가족위원회의 예결위 회의가 열린다. 이 자리에서 미혼모 관련 예산이 얼마나 논의될지는 미지수다. 복지부의 박숙자 가족정책관은 “늘고 있는 청소년 미혼모 문제를 더 이상 방치해선 안 된다”며 “최소한 양육비와 의료비, 그리고 교육과 자립자금 지원만큼은 시급히 도입돼야 한다”고 주장했다. 복지위의 손숙미(한나라당) 의원도 “근거 자료가 부족한 건 사실이지만 부분적으로라도 하루빨리 시작은 할 수 있도록 최선을 다할 예정”이라고 말했다.

억압된 것은 기필코 귀환한다. 1956년에서 94년까지 한국은 38년간 세계 1위의 ‘고아 수출국’이었다. 전쟁 뒤 혼혈아를 대상으로 관행화된 해외입양은 이후 미혼모 아이들의 ‘수출’을 체계화한 ‘입양산업’으로 자리잡아, 1985년엔 9천 건으로 국내 출산의 1.4%를 차지하기도 했다. 지난 50여 년간 전세계 해외입양 중 3분의 1이 한국인 입양이었다. 그동안 한국에선 무슨 일이 있었나? 전세계 유례를 찾아볼 수 없는 경제성장과 정치적 민주화가 이루어졌다. 그렇다면 왜?

최영희 의원, <입양촉진 및 절차에 관한 특례법 개정을 위한 공청회> 개최

국회 보건복지가족위원회․여성위원회 소속 민주당 최영희 의원은 11월 10일 국회 의원회관 128호에서 <입양촉진 및 절차에 관한 특례법 개정을 위한 공청회>를 개최한다. 이번 토론회는 국회 아동청소년 미래포럼(공동대표: 국회의원 최영희․이주영) 주최로 열리며, 진실과 화해를 위한 해외입양인모임(TRACK), 국외입양인연대(ASK), 뿌리의 집, 공익변호사그룹 공감이 후원한다.

최영희 의원은 인사말을 통해 “우리나라가 저출산 국가로 몸살을 앓고 있으면서도 정작 낳은 아이들은 입양을 권하는 ‘아동수출대국’이라는 오명을 앓고 있다”고 지적하며 “해외입양인들이 이억만리에서 자신의 뿌리를 찾고자 한국에 와도 출생에 관한 정확한 정보를 제공받지 못하거나 부모를 만나지 못하여 한국으로부터 또다시 상처를 받은 채 돌아간다”며 공청회 개최이유를 밝혔다.

발제자로 나선 입양인 당사자인 Jane Jeong Trenka은 “해외입양인들이 한국에 돌아왔을 때, 이미 호적이 등록되어 있던 경우에는 고아호적을 새로 만들고 양부모에게 보내지는 아동신상에 관한 서류가 조작되는 등 ‘아동세탁 (child laundering)’이 이루어졌음을 발견하게 되었다”고 지적했다. 그 결과 “해외 입양인 가족 상봉이 2.7% 밖에 되지 않는다”며 “제대로 된 입양사후서비스를 위해 감독기관의 설립이 필요하다”고 역설했다.

또다른 발제자인 공익변호사그룹 공감의 소라미 변호사는 “그동안 ‘입양촉진 및 절차에 관한 특례법’에서의 입양은 고아와 같은 ‘요보호아동’을 주된 대상으로 삼아 이들에 대한 최선의 정책으로 입양을 촉진하고, 입양촉진을 위해 입양절차를 간소화해왔던 구시대적인 발상에서 비롯되었다”고 지적했다. 그러나 “이제는 친생부모가 양육을 포기한 ‘일반 아동’에 대한 입양절차 전반이 아동의 복리를 중심으로 이루어질 수 있도록 국가가 관리 감독을 강화하고, 이에 우선하여 최선의 아동 보호는 출신가정과 출신국가 내에서의 양육이라는 국제법적 원칙이 발현될 수 있도록 제도를 정비하는 것이 필요하다”며 법 개정안의 필요성을 강조했다. 아울러 법 개정안에서는 “입양 절차에 있어서 아동의 이익이 최우선이라는 원칙을 명시하고, 친모의 직접 양육 선택권 보장을 위한 입양숙려제도의 도입, 그리고 만 19세 이후 입양인에게 입양 서류에 대한 열람 등사 신청 권한을 ‘권리’로서 보장 등을 명시하였다”고 밝혔다.

토론자로 참석한 미혼양육모 모임인 ‘미스 맘마미아’의 최형숙 대표는 “미혼모는 정신적으로 불안하고 안정이 되지않은 상황인데 입양기관의 상담은 양육에 대한 정보는 제외된 채 입양만을 권하고 있다”며 “이는 아이를 위한 최선의 선택이라 생각하게 만들 수 있다”고 말했다. 아울러 “입양기관에서 출산 전부터 입양동의서 친권포기서를 받는 일은 없어야 한다”고 지적했다.

또다른 토론자인 국민권익위원회 복지노동민원과 전성휘 조사관은 ’08년 8월부터 ’09년 9월까지 입양과 관련하여 국민신문고에 접수된 민원이 193건을 바탕으로 보건복지가족부, 법무부 등 4개 부처에 8개 제도의 개선을 권고한 내용을 발표했다. 아울러 “각급 입양기관별로 개별적･산발적으로 관리되고 있는 입양관련 정보를 중앙입양정보원으로 이관하여 정보를 통합 운영하는 것이 필요하다”고 지적했다.

최영희 의원은 오늘 논의된 내용을 바탕으로 「입양촉진 및 절차에 관한 특례법」개정안을 이번 정기국회에 제출하고, 우리나라도 미국, 프랑스, 호주 등 총 78개국 가입해있는 ｢국제입양 관련 아동보호 및 협력에 관한 협약｣(‘헤이그 협약’)을 비준할 것을 촉구할 예정이다.
